''This leads to a suspicion if the DMK regime is acting in support of anti-social elements.'' NEW DELHI: The Congress on Sunday said there were many discrepancies in the investigation conducted previously into Rohith Vemula's death in 2016 and asserted that its government in Telangana will leave no stone unturned to ensure justice for his family. Police in Telangana have filed a closure report before a court in its probe into the death of Rohith Vemula, a student of the University of Hyderabad, claiming he was not a Dalit and died by suicide in 2016 as he feared that his eal caste would be discovered. Congress general secretary, organisation, K C Venugopal, said Rohith Vemula's death was a grave atrocity that completely exposed the anti-Dalit mindset of the BJP. The Congress, including Rahul Gandhi ji, has stood with Rohith Vemula's family through this difficult period, he said in a post on X. As has been clarified by the Telangana Police, the closure report concerned was prepared in June 2023, Venugopal said. There were many discrepancies in the investigation conducted previously. The Congress government in Telangana will leave no stone unturned to ensure justice for Rohith's family, he asserted. The Congress came to power in the state last year by defeating the Bharat Rashtra Samithi (BRS). Justice league: Telangana HC issues notices over breach of 50% quota ceiling

A division bench of the Telangana High Court, hearing a writ petition challenging the rise in reservations for Scheduled Tribes (ST) in education and government jobs on Tuesday, issued notices to key government officials. Perkampally Shyam Sundar Reddy and other Group 1 aspirants filed a writ petition questioning the legality of GO 33 issued by the principal secretary of the Tribal Welfare department on September 30, 2022, raising the reservations for STs from 6% to 10% in educational institutions and state government services. The petitioners argued that this increase breaches the upper ceiling limit of 50% for reservations to Scheduled Castes (SC), STs and Other Backward Classes (OBCs) as mandated under Articles 14, 15, and 16 of the Indian Constitution. They also contend that this move disregards previous rulings by the Supreme Court of India. The matter was adjourned to June 28. SBI told to ensure parity in punishment to staffers Justice Namavarapu Rajeshwar Rao of the Telangana High Court on Saturday highlighted the necessity of parity in punishments for co-delinquents, criticising the State Bank of India (SBI) for discrepancies in disciplinary actions against its branch managers. The verdict came in response to a petition filed by PTM Gopala Krishna, former Manager of SBI, Moula Ali branch, who was dismissed from service for his alleged involvement in the issuance of fake bank loan sanction letters for overseas education. Gopala Krishna, along with two other bank managers, was accused of orchestrating a scheme involving fraudulent loan sanction letters. Despite facing similar allegations, the disciplinary authority of the bank administered minor penalties such as a reduction in increments to the other two managers, while Gopala Krishna bore the brunt with the severe punishment of removal from service. The court rebuked the SBI for the discrepancy in punishments and urged a reconsideration of the severity of Krishnas penalty.

BENGALURU : Majority of the cyber crime cases reported, conclude with closure reports, usually filed where there are not sufficient grounds to investigate, shortly after the victims bank accounts are blocked. Due to the trend of increasing complexity and limited manpower within the city police department, cyber fraud cases are not being prioritised, said a senior officer attached to cyber crime investigations said. The fraudsters are more dedicated in planning the crime than the whole investigation planning. Most of the time, cyber crime investigations are on the back foot when other obligations such as bandobast or election duty or dealing with law and order crimes take priority, the senior official highlighted. The official added that, unlike minor law and order incidents like chain snatching, which are addressed with utmost seriousness, not always is a specialized team working exclusively on the cyber crime. Given this trend, detection will remain unattainable even if the reporting percentage rises. In conventional crimes, even if the amount of money lost is not significant, the visual panic it creates is evident, unlike cybercrime, where apart from the victim, nobody else is visibly affected by the incident, a senior official highlighted, and further said that unlike in conventional crime, where investigating officers can often trace the accused using CCTV footage and other physical evidence, tracking down a cyber fraudster is nearly impossible, due to multiple IP addresses. Solving cyber crime cases often involves coordination between interstate law enforcement authorities, and once the accused is tracked down, it can solve more than 100 cases at a time as the fraudster uses thousands of SIM cards, multiple laptops, and phones, and tries different modus operandi on multiple victims. While increasing the number of police forces involved in cracking these cases is essential, banks and telecom companies must also ensure that online payments cannot be completed while someone is still on a call. This is necessary because these fraudsters often distract victims on calls, said the senior official. He added that an SMS alert or call should be triggered, whenever uses a different IP address to login, or makes payments at unusual times in case of net banking.

CJI DY Chandrachud calls for global efforts to combat juvenile cybercrimes

NEW DELHI : Chief Justice of India D Y Chandrachud on Saturday said juvenile justice systems must recognise its vulnerabilities and enhance international cooperation by sharing best practices to tackle growing digital crimes involving minors. The CJI made the observation in Nepal where he is on a three-day official visit at the invitation of Chief Justice of Nepal Bishwombhar Prasad Shrestha. Addressing a gathering at the National Symposium on Juvenile Justice in Nepal, Chief Justice Chandrachud said, When discussing juvenile justice, we have to recognise the vulnerabilities and unique needs of children embroiled in legal conflicts and ensure that our justice systems respond with empathy, rehabilitation, and opportunities for reintegration into society. He also pointed out that the children are often driven towards delinquent behaviour by complex societal challenges like economic disparities and social inequalities. Family breakdowns resulting from issues like domestic violence or poverty can leave children without the necessary guidance, making them more susceptible to negative influences, the CJI noted. Citing the momo challenge he said that it was a viral hoax that spread through social media platforms in 2019, targeting children and adolescents. This hoax purported a series of escalating dares, including self-harm or suicide, although it was later debunked. Its rapid dissemination highlights the susceptibility of juveniles to online dangers. There is a need for proactive measures to educate and safeguard young individuals in the digital age, emphasising digital literacy, responsible online behaviour, and effective parental guidance as crucial components in mitigating cyber-related risks, Chandrachud said. Highlighting that a holistic approach is needed and it was the need of the hour, the CJI said, the correlation between economic resources and juvenile delinquency needs to be addressed. The CJI also appreciated the efforts of the Supreme Court of Nepal, the Secretariat of the Central Child Justice Committee, and UNICEF Nepal for organising a symposium that not only fosters discourse but underscores a collective commitment to safeguarding the rights and well-being of children, who epitomise the future of innovation, growth, and humanity.

Under the Medical Termination of Pregnancy (MTP) Act, the upper limit for aborting the foetus is 24 weeks for married women as well as those in special categories, including rape survivors and other vulnerable women, such as those differently-abled and minors. CJI Chandrachud, who is in Nepal on a three-day official visit at the invitation of Chief Justice of Nepal Bishwombhar Prasad Shrestha, on Saturday narrated the case of the minor girl while addressing a National Symposium on Juvenile Justice here. India has been making consistent efforts to evolve its juvenile justice system, he said. The implementation of various juvenile justice legislations for around four decades in India has led to the establishment of facilities, structures, and systems addressing children's needs within the protection system, he said. ''In fact, juvenile justice is not confined solely to the dictates of the Juvenile Justice Act but is rather shaped by the intricate interplay of various legislative acts,'' he said. ''A recent case brought before the Supreme Court of India exemplifies this: a 14-year-old sought permission to terminate her pregnancy under the Medical Termination of Pregnancy Act of 1971. Fearing repercussions and hindered by her innocence, she kept silent about the abuse she endured until she was well into her pregnancy,'' he said. Recognising the importance of safeguarding her mental and physical well-being, the apex court granted her request for termination. However, she ultimately decided against it, he noted. A critical challenge in the effective implementation of juvenile justice laws is the insufficient infrastructure and resources, especially in rural regions, the CJI said. Inadequate juvenile detention centres or rehabilitation homes may lead to overcrowding and substandard living conditions, hindering efforts to provide proper support and rehabilitation to juvenile offenders, he said. ''Moreover, limited access to essential services such as counselling, education, or vocational training further complicates the successful reintegration of juveniles into society,'' he added. He said the implementation of the juvenile justice laws needs to take social realities into account. ''A study titled 'Rights of Children: A Case Study of Child Beggars at Public Places in India' highlights the alarming reality that approximately 44,000 children are ensnared by criminal gangs in India every year. These children are coerced into engaging in begging, trafficking, smuggling, and other criminal activities,'' the CJI said. The implementation of juvenile justice laws should also consider the unique challenges faced by juveniles with disabilities. ''For instance, the United Nations Office on Drugs and Crime in its report (2020) documented the exploitation of visually impaired children in India, who were coerced into begging by criminal syndicates, exploiting both their disability and socio-economic circumstances. ''In light of such realities, it becomes imperative for juvenile justice systems to adopt tailored approaches that address the specific needs and vulnerabilities of these marginalised groups, ensuring their protection and rehabilitation,'' he added. At the same time, he said the changing nature of crimes, particularly with the increasing prevalence of digital crime, poses new challenges for juvenile justice systems globally. ''I emphasise that juvenile justice plays a crucial role in shaping a fair and equitable society through its focus on reformative measures. By placing the well-being of children at the forefront and offering access to rehabilitation and support services, juvenile justice systems help create an environment conducive to the overall growth and development of young offenders,'' he said. ''Quite often, we focus more on offences committed by juveniles than reflecting on their reformation,'' the CJI said. It thus becomes essential to acknowledge the complex nature of juvenile delinquency and take a comprehensive approach that addresses the underlying socio-economic factors contributing to such behaviour, he said. ''By investing in strategies that prevent, intervene, and rehabilitate, we can build a society that is more inclusive and provides every child with the opportunity to fulfil their potential,'' he added.

A petition will be filed in the court concerned requesting the Magistrate to permit further investigation into the case, he said in a statement on Friday night. The police gave a clean chit to the accused, including incumbent Haryana Governor Bandaru Dattatreya, former BJP MLC N Ramchander Rao, and cited lack of evidence in the case.

Addressing a National Symposium on Juvenile Justice, Chief Justice Chandrachud said, ''When discussing juvenile justice, we have to recognise the vulnerabilities and unique needs of children embroiled in legal conflicts and ensure that our justice systems respond with empathy, rehabilitation, and opportunities for reintegration into society.'' It is crucial to grasp the multifaceted nature of juvenile justice and its intersections with various dimensions of the societies, he said. Chandrachud said with technology evolving rapidly, juveniles are diving into cybercrimes like hacking, cyberbullying, online fraud, and digital harassment. The anonymity and accessibility of digital platforms lower barriers to entry, luring young individuals into illicit activities. He cited the ''Momo Challenge'' as an example. The 'Momo Challenge' was a viral hoax that spread through social media platforms in 2019, targeting children and adolescents. This hoax purported a series of escalating dares, including self-harm or suicide, although it was later debunked. ''Its rapid dissemination highlights the susceptibility of juveniles to online dangers. There is a need for proactive measures to educate and safeguard young individuals in the digital age, emphasising digital literacy, responsible online behaviour, and effective parental guidance as crucial components in mitigating cyber-related risks,'' Chandrachud said. The juvenile justice systems, he said, ''must thus adapt by enhancing international cooperation mechanisms and sharing best practices to address the transnational nature of digital crimes involving juveniles''. ''This includes establishing protocols for extradition and repatriation, as well as facilitating information sharing and cooperation between law enforcement agencies,'' the Chief Justice said. At the domestic level, he said, specific training in child protection rules is essential to ensure that all stakeholders involved in the juvenile justice system have the necessary knowledge and skills to safeguard the rights and well-being of children. This training should encompass various aspects of child protection, including understanding child development, recognising signs of abuse or neglect, and familiarising oneself with relevant laws and procedures, he said. Moreover, training programs should incorporate principles of trauma-informed care, emphasising sensitivity and empathy towards juvenile offenders who may have experienced adverse experiences, he said. Chandrachud said, ''Quite often, we focus more on offences committed by juveniles than reflecting on their reformation. It thus becomes essential to acknowledge the complex nature of juvenile delinquency and take a comprehensive approach that addresses the underlying socio-economic factors contributing to such behaviour. Pakistan Establishes Dedicated Body to Combat Escalating Cybercrimes The Pakistan government has set up a new body to exclusively tackle the rising number of cybercrimes in the country, officials said. The National Cyber Crimes Investigation Agency (NCCIA) was formed under Section 51 of the Prevention of Electronic Crimes Act 2016 (PECA) and would take over the functions of the now-defunct Cybercrime Wing of the Federal Investigation Agency (FIA). According to the officials, all existing personnel, assets, liabilities, rights, obligations, privileges, inquiries and investigations related to the FIAs Cybercrime Wing would now stand transferred to the NCCIA. But the existing personnel of the Cybercrime Wing would continue to perform their duties for another year until the appointment of staff in the NCCIA. The NCCIA will be headed by a director-general, chosen by the federal government to serve a two-year term. It pointed out that the candidate would have to have not less than 15 years of experience in the fields of computer science, digital forensics, cyber technology, law, public administration, information technology, telecommunication or related fields to enable him to deal with offences under the PECA Act. The notification said the NCCIA chief would exercise the powers of an inspector general of police while the agencys affairs related to the federal governments business would be allocated to the Interior Division. It added that the NCCIA would also be the designated agency in respect of international cooperation. Earlier, the caretaker government had approved the NCCIA in December to take over cybercrime investigations from the FIA. According to Information Minister Attaullah Tarar, the new body was needed to eradicate online crimes.
