Karnataka HC dismisses DNAs petition against Chinnaswamy stadium stampede inquiry report
BENGALURU: The Karnataka High Court on Monday dismissed the petition filed by the event management company challenging the report of the Justice John Michael Cunha Commission into the stampede at M Chinnaswamy Stadium that claimed 11 lives during the IPL title celebration of Royal Challengers Bengaluru (RCB). The division bench of Justice D K Singh and Justice Tara Vitasta Ganju noted that the state government has given an undertaking that no action would be taken against M/s DNA Entertainment Networks Private Limited, solely based on the findings of the report of the Commission of Inquiry but only after giving the firm an opportunity of hearing. Referring to the judgment of the Supreme Court in the Goa Foundation case and the undertaking given by the state government, the court said that, the government will make its own assessment of the facts. Considering the discussions made in the order and the specific stand of the state, the apprehension of the petitioner that, without an opportunity of being heard, an action would be taken against it on the basis of the report does not survive. We find that no further orders are required. The writ petition is therefore dismissed, the court noted. The court stated that the Commission was set up by the government on June 5, 2025, as a fact-finding body. The petitioner was issued notice by the commission, and the petitioner never demanded the depositions of the witnesses or the opportunity to cross-examine the witnesses already examined before July 4, 2025. As an afterthought attempt, the petitioner filed the memo dated July 4 before the commission, demanding depositions of all the witnesses and opportunity to cross-examine the witnesses, knowing fully that the terms of the commission would end on July 10 and the commission was to submit the report on or before July 10, 2025. Therefore, the court is of the view that the petitioner has filed this petition as an afterthought attempt to avoid any action(s) on the basis of the recommendation made by the commission in its report dated July 10, the court said while dismissing the petition by taking note of the undertaking given by the state government.
Current Kaveri 2.0 layout creates legal vacuum: Karnataka HC
BENGALURU: The Karnataka High Court has directed the Departments of Stamps and Registration and Revenue to introduce a new workflow within Kaveri 2.0 titled Mutation Based on Civil Court Decree in collaboration with the Centre for Smart Governance (CSG). The court passed an order stating that the current configuration of Kaveri 2.0 inadvertently creates a legal vacuum, treating decrees of competent civil courts over property disputes as if they were extra-statutory or non-existent for mutation purposes, which compels citizens to seek multiple endorsements, verifications, and certifications for matters conclusively decided by courts. Justice Sachin Shankar Magadum issued the directions by allowing the petition filed by Gilbert Vas and others seeking directions to the Tahsildar of Bantwal taluk to consider their application and affect the khata transfer in their favour, as per the terms of the compromise final decree passed in an original suit by the sessions court in Dakshina Kannada. The court noted that the present Kaveri 2.0 framework, being primarily transaction-oriented (sale, gift, mortgage, inheritance), does not adequately accommodate mutations arising from civil court decrees. This has resulted in recurring administrative ambiguity when revenue authorities attempt to give effect to judicially declared rights. This scenario frustrates the object of Section 128 of the Karnataka Land Revenue Act, which seeks to ensure that all acquisitions of rights, whether by act of parties or operations of law, are duly recorded in the revenue registers, and also contravenes Section 135, which requires revenue records to be amended in accordance with judicial declarations, the court added. To restore coherence between judicial adjudication and administrative execution, and to ensure that binding civil court decrees automatically receive recognition within the states digital revenue infrastructure, the directions are issued, the court said.
