Former U'khand CM under fire for intervening in HC transfer case

DEHRADUN: Amidst the controversy surrounding the Uttarakhand High Court's order to shift from Nainital, lawyers have petitioned the Supreme Court to challenge the decision. Meanwhile, former Chief Minister and Governor Bhagat Singh Koshyari requested the incumbent Chief Minister to intervene in the matter, supporting Kumaon lawyers who are opposing the High Court relocation issue. A special leave petition has been filed in the Supreme Court by lawyers hailing from various districts of Kumaon, including members of the High Court Bar Association, opposing the directive issued by the double bench led by Nainital High Court Chief Justice Ritu Bahri to relocate the High Court to IDPL Rishikesh. Conversely, advocates in the capital city of Dehradun criticized Koshyari's letter, stating that at his age, he should focus on spiritual pursuits like 'Ram Bhajan' rather than engaging in politics. Speaking to TNIE, Rajeev Sharma, President of the Dehradun Bar Association, stated, Our legal team has been closely monitoring this entire situation. Renowned advocate Siddharth Luthra is representing us, and we are prepared to intervene as a local stakeholder if necessary. According to the information received, The Supreme Court had listed the matter for July 8 under a special leave petition, in response to which lawyers from Nainital sought an earlier date in court citing urgency. The court has fixed a date for May 24 on this matter. Our teams are consistently visiting colleges, schools, and institutions to ensure maximum participation of people in the public opinion gathering, President Rajeev Sharma told this newspaper. Speaking to The New Indian Express, DCS Rawat, the president of the High Court Bar Association, stated, We are vehemently opposing the shifting of the High Court or establishment of benches, and in this regard, we have filed our petition in the Supreme Court. It is appropriate for the High Court to remain in Nainital to maintain harmony among the regions of Garhwal, Kumaon, and the plains of the state. It was decided at the time of the state's formation that the capital Dehradun and the High Court would be in Nainital. Any change in this regard would tamper with the fundamental sentiments of the residents, Rawat added.

DEHRADUN: Former Uttarakhand Chief Minister Bhagat Singh Koshyari has also entered the fray amidst the growing discontent among lawyers in the state. This comes in light of the ongoing dispute within bar associations across various districts following the High Court's directive to conduct a referendum on the relocation of the Nainital High Court to IDPL, Rishikesh. The former CM has penned a meticulously crafted letter comprising 10 pointed objections to Chief Minister Pushkar Singh Dhami regarding the recent High Court ruling. In his eloquent communication, he 'scrutinizes' the decision-making process of the judiciary in this particular case. Koshiyari's remarks were prompted by a ruling from the two-judge panel of the Nainital High Court led by Chief Justice Ritu Bahri, which mandated a referendum to decide on relocating the High Court to IDPL Rishikesh. In his letter, he argues, Though I may not be a legal expert, due to my long experience as a member of both Parliament and Legislature, I believe that decisions on the appointment of state institutions must be taken by Parliament or legislature, with respect for the judiciary as well. The significance of the 10-point letter, written by Bhagat Singh Koshyari, a veteran BJP leader from the Kumaon region and a staunch follower of the RSS, is being analysed from a political perspective. Koshyari is known as the political mentor of current Chief Minister Pushkar Singh Dhami, who hails from Kumaon. In Kumaon, the High Court stands as the sole remaining major institution, facing threats of relocation despite the established agreement during the state's formation that the High Court would be situated in Kumaon if the capital remained in Garhwal, expressed Koshiyari with concern in his letter. Justifying the High Court's earlier decision to shift the High Court to the Golapar area of Nainital, the former CM said, The administration has taken this process forward and selected about 26 bighas of land in Goulapar and completed the process for no objection from the Forest Department. Land has also been selected for re-plantation elsewhere to compensate the forest department. In such a situation, the direction given to find an alternative place elsewhere for the High Court cannot rule out the possibility of spreading discontent in the area, said Koshiyari.

Uttarakhand HC orders creation of portal to seek feedback on shifting court from Nainital

DEHRADUN: In response to the strong backlash from members of the Nainital Bar Association regarding the High Courts decision to shift to IDPL Rishikesh, a division bench comprising Chief Justice Ritu Bahri and Justice Rakesh Thapliyal has directed the Registrar General to establish a dedicated online portal to gather comprehensive views from stakeholders. The 850-acre IDPL Rishikesh land is available for relocation. There are no trees in IDPL Rishikesh, making it practical to shift the High Court here with minimal investment. Nainital faces significant challenges in terms of connectivity, medical facilities, and residential amenities, Dehradun Bar Association president Rajeev Sharma told this newspaper. The recent demise of senior advocate Paresh Tripathi due to a lack of medical care following a heart attack highlights the absence of medical facilities, Sharma added. Earlier on Wednesday, the High Court had asked the state government to explore the possibility of transferring a bench to IDPL Rishikesh. The bench has mandated the Registrar General to launch a portal by Tuesday to facilitate the collection of feedback from lawyers and litigants regarding the proposed transfer. This feedback will be gathered through a referendum conducted via the portal. According to HC sources, the portal is scheduled to commence on May 14. It will allow lawyers, litigants, and the public to participate and express their views. The window for public input will remain open until May 31, following which the outcome of the referendum is set to be disclosed on June 7. On Friday, a gathering of the office bearers of the Bar Association of Dehradun and members of the Bar Council convened in Dehradun. They unanimously supported the relocation of the Nainital HC to IDPL Rishikesh, aligning with the courts directives.

Uttarakhand High Court Directs Government to Identify Adequate Site for Court Relocation from Nainital The Uttarakhand High Court has asked the state government to find within a month a suitable place to shift its premises out of Nainital saying its relocation is in larger public interest. ''Considering the larger public interest, it is necessary to shift the High Court from Nainital,'' a division bench of the high court comprising Chief Justice Ritu Bahri and Justice Rakesh Kumar Thapliyal said on Friday. The bench asked the Chief Secretary to select a suitable place for the High Court within a month. It also directed the Registrar General to create a portal to take suggestions from advocates and the general public on the issue. The next hearing in the matter has been scheduled for June 25. On the state government's earlier proposal for shifting the High Court to Gaulapar in Haldwani, the high court observed that the land earmarked for the purpose had 75 per cent forest cover and construction in the area would lead to deforestation. The high court also made a few recommendations for the kind of land required for its relocation and facilities, including proper accommodation for judges, judicial officers, staff and court rooms. The selected area must have adequate space for facilities such as chambers, canteen, parking and conference hall to accommodate at least 7,000 lawyers, the bench said. The area should be near a place which has good medical facilities and good connectivity, it added. The Uttarakhand High Court had directed the state last week to explore the possibility of moving a bench of it to Indian Drugs and Pharmaceuticals Limited, Rishikesh which is now closed but has a sprawling campus spread over hundreds of acres on which former IDPL employees have their residences. The high court's decision to shift its premises has drawn a lot of resistance by the bar association.

The statutory appeal is admitted for hearing. Issue notice on bail plea. The high court has directed him for surrender in three weeks. Till the next date of hearing, he need not surrender.'' Sharma, who along with the likes of Daya Nayak, Vijay Salaskar and Ravindra Angre was part of a dreaded squad of Mumbai police that took on the city's underworld in the 1990s and 2000s and killed scores of alleged criminals, has challenged the Bombay High Court order which sentenced him to life imprisonment in the fake encounter killing of Ramnarayan Gupta, an alleged close aide of gangster Chhota Rajan. On March 19, the high court had upheld the conviction and life sentence imposed on 13 other accused-12 former policemen and a civilian. It said the ''protectors/guardians of law cannot be permitted to act as criminals in uniform and if this is permitted then it would lead to anarchy''. The court noted that the prosecution has proved beyond reasonable doubt the abduction, wrongful confinement and killing of Gupta in a fake encounter with ''credible, cogent and legally admissible evidence''. It, however, quashed the 2013 judgement passed by a sessions court acquitting Sharma due to the lack of evidence and termed it ''perverse and unsustainable''. The high court had convicted Sharma of all charges, including criminal conspiracy, murder, kidnapping and wrongful confinement, and sentenced him to life imprisonment. Sharma is also an accused in the of killing of businessman Mansukh Hiren to whom the SUV used in the Antilia bomb scare case was traced. Hiren had, however, reported to police that the vehicle had been stolen days before the incident. His body was found floating in a creek off a Mumbai suburb a few days after the incident. On November 11, 2006, a police team picked up Ramnarayan Gupta alias Lakkhan Bhaiya from Vashi in Navi Mumbai along with his friend Anil Bheda, and killed him in a staged encounter near Versova in western Mumbai the same evening. Gupta's associate Anil Bheda was released from custody in December 2006. However, in July 2011, a few days before he was scheduled to depose in court, Bheda was also allegedly abducted and killed. The state CID is probing the case. Taking note of Bheda's case, the high court had said till date, the CID has not taken any steps to conclude the investigation and trace the perpetrators. Twenty-two individuals, including 13 policemen, were initially charged in the Ramnarayan Gupta fake encounter killing case. Following a trial, the sessions court in 2013 found 21 of the accused guilty and sentenced them to life imprisonment. Two of the convicted individuals died while in custody. Those convicted filed appeals in the high court, while Gupta's brother Ramprasad appealed against Sharma's acquittal.

NEW DELHI: The Supreme Court on Monday upheld the rules stipulating minimum qualifying marks in the viva voce test as part of the selection criteria for the appointment of judicial officers in Bihar and Gujarat. Taking note of the concerns of the judicial services, aspirants and tardy selection process for judges in the district judiciary, the top court also issued a slew of directions including that the high courts should notify a designated authority for a given recruitment process with clearly defined roles, functions and responsibilities to deal with issues of the candidates. The verdict came from a bench comprising justices Hrishikesh Roy and Prashant Kumar Mishra on a batch of petitions filed by various unsuccessful aspirants of the district judicial services of Bihar and Gujarat. The petitions dealt with the question whether prescribing minimum marks for interview contravenes the 2002 judgment of the apex court in the All India Judges case. The Prescription of minimum qualifying marks for interview is permissible and this is not in violation of All India Judges (2002) which accepted certain recommendations of the K J Shetty Commission, the judgment said. Writing the 59-page judgment for the bench, Justice Roy said the apex court judgment cannot be considered as having authoritatively pronounced on doing away with the minimum cut-off marks in the interview segment. The verdict upheld and termed as legally valid the selection process of Bihar and Gujarat. It also rejected the submissions challenging a clause of the Bihar Rules, 1951 and Rule 8(3) of the Gujarat Rules, 2005 which prescribed minimum marks for interview. The recruitment pertained to the selection of judicial officers of different ranks and respective selection cycles, that is District Judge (Entry Level) by direct recruitment from the Bar (2015 Advertisement) for the State of Bihar and the post of Civil Judge (2019 and 2022 Advertisement) for the State of Gujarat. Besides seeking to set aside the selection, a set of petitions had urged that a clause of the Bihar Superior Judicial (Amendment) Rules was contrary to the recommendation of the Shetty Commission.

New Delhi: The Supreme Court granted anticipatory bail to Omar Ansari, son of Mukhtar Ansari, in a case related to the alleged violation of the Model Code of Conduct. A bench comprising Justices Hrishikesh Roy and PK Mishra directed Omar Ansari to appear before the trial court in connection with the case and release him on bail. Senior advocate Garima Prasad, representing the Uttar Pradesh government, informed the court that Ansari had not appeared in the lower court. The case pertained to accusations of instigating people during a gathering. Prasad mentioned that the co-accused who appeared in the trial court were granted regular bail. He requested the court to direct Omar Ansari to appear before the trial court and seek regular bail instead of anticipatory bail. However, senior advocate Kapil Sibal, appearing for Ansari, opposed Prasad's claim, stating that Ansari had indeed appeared in the lower court and deposited surety bonds. Sibal clarified that although Ansari was present on the stage, he did not utter any objectionable statements. Considering the arguments of both parties, the bench decided to grant anticipatory bail to Ansari. The court directed him to appear before the trial court and deposit a surety bond. Previously, on January 25, the Supreme Court had granted protection from arrest to Omar in the same case. However, the Allahabad High Court had rejected his anticipatory bail application on December 19 last year, stating that a case of crime was made out against him based on the facts and circumstances of the case. The FIR against Abbas Ansari (SBSP candidate from Mau Sadar seat and elder brother of Omar), Omar Ansari, and 150 others was registered on March 4, 2022, at Kotwali police station in Mau district. The allegation in the FIR was that during a public meeting at Paharpura Maidan on March 3, 2022, Omar Ansari had called upon the Mau administration to settle the accounts and had made certain statements regarding transfer-posting of officials under the SP government. According to forest department officials, a case has been registered against four people -- Piyush Singh, Ayush Singh, Rahul Singh and Ankit -- under the Indian Forest Act for setting fire in Gangolihat forest range of Pithoragarh district. The daily bulletin issued by the forest department here said that in the last 24 hours, 24 incidents of forest fire were reported in the state, which affected 23.75 hectares of forest. Meanwhile, CM Dhami also asked all the district magistrates to give orders to completely ban burning of all types of fodder for a week with immediate effect. Besides this, urban bodies have also been asked to ban the burning of their solid waste in or near forests. Dhami held a review meeting with the officials on Saturday regarding the incidents of forest fires happening in the state He asked the officials to establish coordination among themselves and create a mechanism by which the forest fires could be controlled as soon as possible. HYDERABAD: The 2016 Rohith Vemula suicide case has once again sparked protests on Friday after the Cyberabad police released a closure report on his death, citing lack of evidence. Protests erupted at the University of Hyderabad (UoH) campus late evening after around 200 students gathered, demanding justice for Rohith and calling for reinvestigation of the case. Student unions sought support for reopening the case, criticising the Cyberabad Police for a biased investigation. Students also called for action against former Vice-Chancellor Appa Rao Podile and demanded the scrapping of the closure report. The protest, starting from the North Shopping Complex, reached the main entrance with student groups holding banners and chanting slogans calling for justice. PK Rishikesh, vice-president of the Students Federation of India (SFI), said, We are disheartened and upset over the closure report that the Cyberabad Police released today. We condemn the police report and demand a thorough reinvestigation into the case as justice has not been served, despite the case being registered in 2016. Fugitive Suspected of Murder Apprehended in Rishikesh After 27 Years A 77-year-old saint was arrested for the murder of a man which he allegedly committed at least 27 year ago in Delhi's Okhla, police said on Tuesday. A team of the crime branch had to work as volunteer in 'bhandara' for three days to identify and nab the accused, they said. Deputy Commissioner of Police (crime) Amit Goel said that the accused was identified as Ramdas alias Tillu. He was absconding in the murder of a truck helper over a property dispute in 1997. The team had got a tip off that Ramdas may be staying in Rishikesh and they nabbed him on Tuesday. Ramdas told the police that he went to Uttar Pradesh's Kanpur after committing the crime and where he changed his identity and procured a fake identity card. It was found that he converted himself into saint frequently roaming at various religious locations, including Haridwar and Rishikesh, Goel said. The officer said the team conducted field recce in Rishikesh near his last location and voluntarily worked as 'bhandara' distributors in the temples near the location. After continuously working as volunteers for three days, the team identified him and nabbed him from near Geeta Bhawan in Rishikesh, Goel said.

Sabarimala Airport Land Acquisition Halted for 2 Months by Kerala HC The Kerala High Court on Thursday directed the state government not to take any further steps for two months in connection with the preliminary notification to acquire land for the construction of the Sabarimala Greenfield airport in Kottayam district. The interim direction was given by Justice Viju Abraham who also issued notice to the state government and other authorities connected with the airport project, seeking their stand on a plea by a charitable trust and its managing trustee challenging the land acquisition notification. ''Pending consideration of the writ petition, there will be an interim order directing the official respondents not to take any further steps pursuant to Ext.P43 notification (of land acquisition), issued under section 11(1) (of the Land Acquisition Act of 2013), for a period of 2 months,'' the court said. The court also admitted the plea of the trust and directed it as well as the government to maintain status quo in respect of the property. The Ayana Charitable Trust and its managing trustee Siny Punnoose in their joint petition have alleged that the land acquisition process was aimed at illegally taking over their property -- a rubber plantation measuring around 2,263 acres. The trust, also represented by senior advocate Amit Sibal and advocates Rishikesh Haridas and Dhiraj Philip, has claimed that the state government has been attempting to ''grab its property'' ever since it acquired the land in 2005. In its plea, the trust also cited various Kerala High Court orders by which actions initiated by the government to allegedly grab its land were struck down. The state government had earlier said that the Sabarimala Greenfield airport will make it convenient for pilgrims coming from other states to reach the hill-top shrine of Lord Ayyappa in Pathanamthitta district of Kerala. It said that having an airport there would also promote tourism and boost the economy. Besides that, it would also help people of the area travel across the world from there once the airport comes up, the government had said. The Centre has granted the site and defence clearance for the Sabarimala Greenfield Airport project which is being developed on land in Erumeli South and Manimala villages in Kottayam district. Kerala Chief Minister Pinarayi Vijayan had told the state Assembly in February that the application for security clearance for the project is under consideration of the Ministry of Home Affairs. He had also said that an environmental impact study has been done and a seven-member expert committee, appointed to review the final Social Impact Assessment (SIA) study report prepared by the Centre for Management Development (CMD), has submitted its recommendations on the project. Based on the committee's recommendations, the process of acquiring around 2,570 acres of land for the construction of the airport has been initiated, he had said. The petitioners, in their plea, have sought quashing of the appointment of the CMD to carry out the SIA study, its report, the expert committee's recommendations, the sanction granted to proceed with acquisition and the land acquisition notification.

Fire breaks out in coach of Yoga Express in Haridwar, no casualties A fire broke out in a coach of the Yoga Express train at Iqbalpur railway station here on Sunday afternoon, the police said. No casualties were reported in the incident, they said. As soon as the Yoga Express, which was going from Ahmedabad in Gujarat to Rishikesh in Uttarakhand, reached the Iqbalpur railway station, a fire was noticed in the lower portion of one of its coaches, police said. Fire tenders rushed to the spot and brought the fire under control, they said. Sanjay Sharma, in-charge of Laksar GRP police station, said that prima facie, the fire broke out as the train wheels heated up due to friction caused by brake application. All the passengers were deboarded from the train and the fire was extinguished, he said. There was no loss of life or property in the incident, he added. Due to the fire, the train was stationed at Iqbalpur station for about one-and-a-half hours. After the minor damage was repaired, the train left for Rishikesh, Sharma said.

Tragic Accident Claims Four Lives in Vijayapura District in Karnataka

VIJAYPURA: Four people from a family were killed and three injured in an accident between a car and cement-laden truck near Arjunagi of Babaleshwar Taluk in Vijayapura district on Saturday. A family of seven, traveling in a car, was en route from Vijayapura to Mahalingpur of Bagalkot when tragedy struck. According to reports, a cement-laden truck traveling in the opposite direction collided with the car. Four members of the family, identified as Arjun Rajaput (32), his 12-year-old son Megharaj, Arjuns father-in-law Ravindranath Pattar (52), and Ravindranaths wife Pushpa (40), lost their lives in the accident. Arjuns wife Jayashri, daughter Nayara, and another son Arjun sustained injuries and were rushed to the hospital by the authorities. Meanwhile, the mortal remains of the four killed were shifted to the district hospital. Senior police officials led by SP Rishikesh Sonawane visited the spot.

Ankit Negi, a resident of the Chamoli district, said that choosing the Army as a career option was the primary choice of every youth here, especially those from the hills or rural areas. Eight years (from 17 to 25) are crucial for every youth who decides where they will head in life. It decides the future of the person and his family as well. However, after the introduction of this scheme, the youth is deeply agitated. The youth of hill areas are known for their physical strength. Every youth here used to be very enthusiastic about choosing the Army as their career option. The BJP is not focusing on this issue and it is also not in their election manifesto, due to which most of the youngsters here are not in favour of voting for the party, Negi said. Abhinav Patwal, a resident of the Pauri district, said the youth were ''angry'' after announcement of the scheme two years ago. We have protested a lot and showed our displeasure regarding the scheme which was imposed on us. Since the announcement of the scheme, we have seen several agitations across the country. We have also tried to share our views about the scheme with the central government via several mediums. We are clear in our minds that if the scheme is not scrapped, then we will not vote in favour of the BJP, Patwal said. In June 2022, the government rolled out the Agnipath recruitment scheme for short-term induction of personnel with an aim to bring down the age profile of the three services. It provides for recruiting youths between the age bracket of 17-and-half years and 21 for four years with a provision to retain 25 per cent of them for 15 more years. Umesh Rana, a resident of Srinagar (Uttarakhand), said men are ''upset'' with the Agnipath scheme, while women are concerned about their safety following the Ankita Bhandari incident. Bhandari, a 19-year-old receptionist at a resort near Rishikesh in the state, was allegedly killed by the resort owner and two of his accomplices in 2022. Shikha Gusain, who hails from the Rudraprayag district of Garhwal, said, Bhandari was our daughter and justice is yet to be delivered. Every political party always talks about women safety in every poll campaign, but if this happens to our daughters or sisters, how will women be safe...'' Even the local leaders from the Congress and BJP at Karnprayag in the Chamoli district agree that these two issues will be in the minds of voters when they go to cast their votes. Ishwari Prasad Maikhori, a local Congress leader, said the party is aggressively raising these issues. The BJP wants to fight on national issues, they are not focusing on these points and they have not included these in their election manifesto. The youth of the hill state are silently watching it and they will give a strong message on April 19 when they cast their votes. Congress candidate Ganesh Godiyal is actively talking about these issues, he said. The Congress has been demanding a CBI probe into Bhandaris murder. Harish Sati, a local BJP leader, said, We accept that these points will have an impact on the polls since people in Uttarakhand are emotionally connected with Army jobs, and with the Ankita Bhandari case. However, the development work of the BJP will also play an important role here. Naresh Sharma, a resident of Pauri, said the BJP should not forget that the youth had played a crucial role in 2014, following which the BJP came to power after a decade. He said the weak Congress governments could not strengthen the border infrastructure. Now, roads and modern tunnels are being built along the borders. Modi spoke of Rishikesh's tourism potential. It is a unique blend of adventure and spiritual tourism, he said. He spoke the mega road, rail and air infrastructure projects underway in the state and said they would boost tourism in the state like never before and create employment opportunities. The BJP government in Uttarakhand led by Pushkar Singh Dhami is working constantly towards achieving the goal of making it a leading state by 2025, he said. Rishikesh, where the rally was held, falls under Haridwar Lok Sabha constituency. Chief Minister Dhami, Haridwar candidate Trivendra Singh Rawat, Tehri Garhwal MP Mala Rajya Laxmi Shah and Pauri Garhwal candidate Anil Baluni shared the dais with the prime minister.
