CJI DY Chandrachud calls for global efforts to combat juvenile cybercrimes
NEW DELHI : Chief Justice of India D Y Chandrachud on Saturday said juvenile justice systems must recognise its vulnerabilities and enhance international cooperation by sharing best practices to tackle growing digital crimes involving minors. The CJI made the observation in Nepal where he is on a three-day official visit at the invitation of Chief Justice of Nepal Bishwombhar Prasad Shrestha. Addressing a gathering at the National Symposium on Juvenile Justice in Nepal, Chief Justice Chandrachud said, When discussing juvenile justice, we have to recognise the vulnerabilities and unique needs of children embroiled in legal conflicts and ensure that our justice systems respond with empathy, rehabilitation, and opportunities for reintegration into society. He also pointed out that the children are often driven towards delinquent behaviour by complex societal challenges like economic disparities and social inequalities. Family breakdowns resulting from issues like domestic violence or poverty can leave children without the necessary guidance, making them more susceptible to negative influences, the CJI noted. Citing the momo challenge he said that it was a viral hoax that spread through social media platforms in 2019, targeting children and adolescents. This hoax purported a series of escalating dares, including self-harm or suicide, although it was later debunked. Its rapid dissemination highlights the susceptibility of juveniles to online dangers. There is a need for proactive measures to educate and safeguard young individuals in the digital age, emphasising digital literacy, responsible online behaviour, and effective parental guidance as crucial components in mitigating cyber-related risks, Chandrachud said. Highlighting that a holistic approach is needed and it was the need of the hour, the CJI said, the correlation between economic resources and juvenile delinquency needs to be addressed. The CJI also appreciated the efforts of the Supreme Court of Nepal, the Secretariat of the Central Child Justice Committee, and UNICEF Nepal for organising a symposium that not only fosters discourse but underscores a collective commitment to safeguarding the rights and well-being of children, who epitomise the future of innovation, growth, and humanity.

Imran Khan Alleges Bias from Chief Justice Isa against His Party
Imran Khan Alleges Bias from Chief Justice Isa against His Party Pakistan's jailed former prime minister Imran Khan has accused the country's Chief Justice Qazi Faiz Isa of being biased against his party and urged the judiciary to expedite the hearing of his cases, according to a media report. In a message to journalists from Adiala Jail in Rawalpindi where he is lodged, Khan, 71, called Justice Isa the ''B team'' of the current government led by Prime Minister Shehbaz Sharif and said that the delay in his legal matters was unjust, The Express Tribune newspaper reported. I urge all judges presiding over my cases to expedite the hearings and refrain from unjustified delays, he said, adding that delaying the decisions was unjust. Referring to Chief Justice Isas statement about no pressure on him to make decisions, Khan said that the top judge of the country was acting as the second team of the current government. ''He stated that there is no pressure on him, but the pressure comes to those who refuse to indulge in wrongdoing. You are behaving like [the governments] B-team against the Pakistan Tehreek-e-Insaf (PTI), Imran claimed. You snatched the electoral symbol from the PTI, denied a level-playing field, and violated our fundamental human rights in the guise of the May 9 incidents, on which our petition has been pending since May 25, 2023, without a hearing till today, he was quoted as saying in the report on Friday. The PTI founder stated that the PTIs petitions against rigging during the general elections had not been heard yet, adding that the issue of allocation of the reserved seats for women to the party was also pending. The Supreme Courts decisions have revived the doctrine of necessity once again. This is a historic opportunity for great nations to capitalise on historic moments, Khan emphasised. The February 8 general elections delivered a fractured mandate. Independent candidates a majority backed by Khan's PTI party won 93 seats in the 336-member National Assembly. Former three-time prime minister Nawaz Sharifs Pakistan Muslim League-Nawaz (PML-N) won 75 seats while the Bilawal Zardari Bhutto-led Pakistan Peoples Party (PPP) came third with 54 seats. The Muttahida Qaumi Movement Pakistan (MQM-P) won 17 seats. Khans party has maintained that the powerful establishment had favoured Sharifs PML-N and that the Election Commission of Pakistan (ECP) deliberately used a different form to declare the results to steal the mandate that belonged to it. He criticised that decisions were being coerced through threats, which was dismantling the countrys judicial system. The remarks of high court judges have proved that the law of the jungle prevails in the country. Its time for Supreme Court judges to stand up like high court judges and reject wrong decisions.

Juvenile Justice Shaped By Intricate Interplay Of Various Legislative Acts: CJI Chandrachud

Legislative Mosaic Shapes Juvenile Justice Framework: Insights from CJI Chandrachud
Legislative Mosaic Shapes Juvenile Justice Framework: Insights from CJI Chandrachud Juvenile justice is not confined solely to the dictates of the Juvenile Justice Act but is shaped by the intricate interplay of various legislative acts, Chief Justice of India D Y Chandrachud has said, recalling how the apex court recently granted a 14-year-old rape survivor's request for termination of her 30-week pregnancy. The top court, on April 22, exercised its powers under Article 142 of the Constitution, which empowers it to pass any order necessary for doing complete justice in any case, while permitting the minor girl to undergo the termination of her 30-week pregnancy. Under the Medical Termination of Pregnancy (MTP) Act, the upper limit for aborting the foetus is 24 weeks for married women as well as those in special categories, including rape survivors and other vulnerable women, such as those differently-abled and minors. CJI Chandrachud, who is in Nepal on a three-day official visit at the invitation of Chief Justice of Nepal Bishwombhar Prasad Shrestha, on Saturday narrated the case of the minor girl while addressing a National Symposium on Juvenile Justice here. India has been making consistent efforts to evolve its juvenile justice system, he said. The implementation of various juvenile justice legislations for around four decades in India has led to the establishment of facilities, structures, and systems addressing children's needs within the protection system, he said. ''In fact, juvenile justice is not confined solely to the dictates of the Juvenile Justice Act but is rather shaped by the intricate interplay of various legislative acts,'' he said. ''A recent case brought before the Supreme Court of India exemplifies this: a 14-year-old sought permission to terminate her pregnancy under the Medical Termination of Pregnancy Act of 1971. Fearing repercussions and hindered by her innocence, she kept silent about the abuse she endured until she was well into her pregnancy,'' he said. Recognising the importance of safeguarding her mental and physical well-being, the apex court granted her request for termination. However, she ultimately decided against it, he noted. A critical challenge in the effective implementation of juvenile justice laws is the insufficient infrastructure and resources, especially in rural regions, the CJI said. Inadequate juvenile detention centres or rehabilitation homes may lead to overcrowding and substandard living conditions, hindering efforts to provide proper support and rehabilitation to juvenile offenders, he said. ''Moreover, limited access to essential services such as counselling, education, or vocational training further complicates the successful reintegration of juveniles into society,'' he added. He said the implementation of the juvenile justice laws needs to take social realities into account. ''A study titled 'Rights of Children: A Case Study of Child Beggars at Public Places in India' highlights the alarming reality that approximately 44,000 children are ensnared by criminal gangs in India every year. These children are coerced into engaging in begging, trafficking, smuggling, and other criminal activities,'' the CJI said. The implementation of juvenile justice laws should also consider the unique challenges faced by juveniles with disabilities. ''For instance, the United Nations Office on Drugs and Crime in its report (2020) documented the exploitation of visually impaired children in India, who were coerced into begging by criminal syndicates, exploiting both their disability and socio-economic circumstances. ''In light of such realities, it becomes imperative for juvenile justice systems to adopt tailored approaches that address the specific needs and vulnerabilities of these marginalised groups, ensuring their protection and rehabilitation,'' he added. At the same time, he said the changing nature of crimes, particularly with the increasing prevalence of digital crime, poses new challenges for juvenile justice systems globally. ''I emphasise that juvenile justice plays a crucial role in shaping a fair and equitable society through its focus on reformative measures. By placing the well-being of children at the forefront and offering access to rehabilitation and support services, juvenile justice systems help create an environment conducive to the overall growth and development of young offenders,'' he said. ''Quite often, we focus more on offences committed by juveniles than reflecting on their reformation,'' the CJI said. It thus becomes essential to acknowledge the complex nature of juvenile delinquency and take a comprehensive approach that addresses the underlying socio-economic factors contributing to such behaviour, he said. ''By investing in strategies that prevent, intervene, and rehabilitate, we can build a society that is more inclusive and provides every child with the opportunity to fulfil their potential,'' he added.
Rohith Vemula's Mother Seeks Justice from Telangana CM Revanth Reddy
Rohith Vemula's Mother Seeks Justice from Telangana CM Revanth Reddy Rohith Vemula's mother Radhika Vemula met Telangana Chief Minister A Revanth Reddy here on Saturday and urged him to see that ''justice'' is done to the family. Reddy assured her that an investigation would be conducted again into the University of Hyderabad student's suicide in 2016 and that justice would be done, an official release said. The chief minister assured that a fair and transparent investigation would be conducted further, Rohith Vemula's brother Raja Vemula told PTI Videos. He expressed confidence that justice would be done to them under the present Congress government. ''We have opposed the closure report submitted by the police. We also raised concerns regarding the issues they have mentioned in the report,'' he said, adding that the competent authority to clarify on the caste status is the district Collector of Guntur in neighbouring Andhra Pradesh and not the police,'' he said. Raja Vemula also said they sought cases filed against some other students to be cancelled. Police have filed a closure report before a local court in its probe into the death of Rohith Vemula, a student of the University of Hyderabad, claiming he was not a Dalit and died by suicide in 2016 as he feared that his ''real caste'' would be discovered. Telangana DGP Ravi Gupta has already announced to conduct further investigation into the case in view of the doubts expressed by Rohith Vemula's mother and others on the closure report. A petition will be filed in the court concerned requesting the Magistrate to permit further investigation into the case, he said in a statement on Friday night. The police gave a clean chit to the accused, including incumbent Haryana Governor Bandaru Dattatreya, former BJP MLC N Ramchander Rao, and cited lack of evidence in the case.

Collaborative Global Efforts Urged by CJI Chandrachud to Combat Juvenile Cybercrimes Chief Justice of India D Y Chandrachud on Saturday said juvenile justice systems must adapt by enhancing international cooperation and sharing best practices to tackle growing transnational digital crimes involving minors, amidst the rapid evolution of technology. Chandrachud is here on a three-day official visit to Nepal at the invitation of Chief Justice of Nepal Bishwombhar Prasad Shrestha. Addressing a National Symposium on Juvenile Justice, Chief Justice Chandrachud said, ''When discussing juvenile justice, we have to recognise the vulnerabilities and unique needs of children embroiled in legal conflicts and ensure that our justice systems respond with empathy, rehabilitation, and opportunities for reintegration into society.'' It is crucial to grasp the multifaceted nature of juvenile justice and its intersections with various dimensions of the societies, he said. Chandrachud said with technology evolving rapidly, juveniles are diving into cybercrimes like hacking, cyberbullying, online fraud, and digital harassment. The anonymity and accessibility of digital platforms lower barriers to entry, luring young individuals into illicit activities. He cited the ''Momo Challenge'' as an example. The 'Momo Challenge' was a viral hoax that spread through social media platforms in 2019, targeting children and adolescents. This hoax purported a series of escalating dares, including self-harm or suicide, although it was later debunked. ''Its rapid dissemination highlights the susceptibility of juveniles to online dangers. There is a need for proactive measures to educate and safeguard young individuals in the digital age, emphasising digital literacy, responsible online behaviour, and effective parental guidance as crucial components in mitigating cyber-related risks,'' Chandrachud said. The juvenile justice systems, he said, ''must thus adapt by enhancing international cooperation mechanisms and sharing best practices to address the transnational nature of digital crimes involving juveniles''. ''This includes establishing protocols for extradition and repatriation, as well as facilitating information sharing and cooperation between law enforcement agencies,'' the Chief Justice said. At the domestic level, he said, specific training in child protection rules is essential to ensure that all stakeholders involved in the juvenile justice system have the necessary knowledge and skills to safeguard the rights and well-being of children. This training should encompass various aspects of child protection, including understanding child development, recognising signs of abuse or neglect, and familiarising oneself with relevant laws and procedures, he said. Moreover, training programs should incorporate principles of trauma-informed care, emphasising sensitivity and empathy towards juvenile offenders who may have experienced adverse experiences, he said. Chandrachud said, ''Quite often, we focus more on offences committed by juveniles than reflecting on their reformation. It thus becomes essential to acknowledge the complex nature of juvenile delinquency and take a comprehensive approach that addresses the underlying socio-economic factors contributing to such behaviour. ''By investing in strategies that prevent, intervene, and rehabilitate, we can build a society that is more inclusive and provides every child with the opportunity to fulfil their potential,'' the Chief Justice of India said while analysing the juvenile justice systems of India and Nepal. He also emphasised that juvenile justice plays a crucial role in shaping a fair and equitable society through its focus on reformative measures. By placing the well-being of children at the forefront and offering access to rehabilitation and support services, juvenile justice systems help create an environment conducive to the overall growth and development of young offenders, Chandrachud added.

Congress commits to eliminate crime from Haryana: Raj Babbar after filing nomination from Gurugram
Congress commits to eliminate crime from Haryana: Raj Babbar after filing nomination from Gurugram Film actor Raj Babbar, Congress candidate from the Gurugram Lok Sabha seat, on Friday said if his party comes to power at the Centre, it will ensure all criminals in Haryana are eliminated and the peace is established in the state. Addressing a public meeting before he filed his nomination, Babbar said the Bharatiya Janata Party (BJP) is completely distraught as it has sensed its defeat in the general assemble elections. Babbar filed his nomination in the presence of former Haryana chief minister Bhupinder Singh Hooda, officials said. Swayam Shashan Party's nominee Dharmendra Thakran and Independent candidate Singh Ram also filed their nomination for the Gurugram seat in the office of District Election Officer Nishant Kumar Yadav, they said. Before Babbar went to submit his nomination paper, a public meeting was held near the Mor Chowk here. On BJP calling him an ''outsider candidate'', the actor said, ''My childhood was spent in Gurugram and I remained associated with this area throughout my life.'' ''Outsiders are those leaders who do not come out of their houses even when they are at home, who never take care of the people of Gurugram. The time has come for such leaders to depart from Gurugram. This time, the public will vote for the Congress,'' he added. Addressing the gathering, former chief minister Hooda said due to the poor law and order situation under the BJP government, miscreants are today committing crimes without any fear, while the ''common man is living under the shadow of fear''. He assured that if a Congress government is formed at the Centre, it will eliminate criminals in entire Haryana, including Gurugram, and establish peace here. Meanwhile, senior Congress leader Mahender Pratap Singh contesting from the Faridabad Lok Sabha seat, also filed his nomination on Friday in the presence of the party's state chief Uday Bhan and other senior leaders in the office of District Election Officer Vikram Singh. Google, Justice Department make final arguments about whether search engine is a monopoly
WASHINGTON: Googles preeminence as an internet search engine is an illegal monopoly propped up by more than $20 billion spent each year by the tech giant to lock out competition, Justice Department lawyers argued at the closings of a high-stakes antitrust lawsuit. Google, on the other hand, maintains that its ubiquity flows from its excellence, and its ability to deliver consumers the results that its looking for. The government and Google made their closing arguments Friday in the 10-week lawsuit to US District Judge Amit Mehta, who must now decide whether Google broke the law in maintaining a monopoly status as a search engine. Much of the case, the biggest antitrust trial in more than two decades, has revolved around how much Google derives its strength from contracts it has in place with companies like Apple to make Google the default search engine preloaded on cellphones and computers. At trial, evidence showed that Google spends more than $20 billion a year on such contracts. Justice Department lawyers have said the huge sum is indicative of how important it is for Google to make itself the default search engine and block competitors from getting a foothold. Google responds that customers could easily click away to other search engines if they wanted, but that consumers invariably prefer Google. Companies like Apple testified at trial that they partner with Google because they consider its search engine to be superior. Google also argues that the government defines the search engine market too narrowly. While it does hold a dominant position over other general search engines like Bing and Yahoo, Google says it faces much more intense competition when consumers make targeted searches. For instance, the tech giant says shoppers may be more likely to search for products on Amazon than Google, vacation planners may run their searches on AirBnB, and hungry diners may be more likely to search for a restaurant on Yelp. And Google has said that social media companies like Facebook and TikTok also present fierce competition. During Fridays arguments, Mehta questioned whether some of those other companies are really in the same market. He said social media companies can generate ad revenue by trying to present ads that seem to match a consumers interest. But he said Google has the ability to place ads in front of consumers in direct response to queries they submit. Its only Google where we can see that directly declared intent, Mehta said. Googles lawyer, John Schmidtlein, responded that social media companies have lots and lots of information about your interests that I would say is just as powerful. The company has also argued that its market strength is tenuous as the internet continually remakes itself. Earlier in the trial, it noted that many experts once considered it irrefutable that Yahoo would always be dominant in search. Today, it said that younger tech consumers sometimes think of Google as Grandpa Google. Mehta has not yet said when he will rule, though there is an expectation that it may take several months. If he finds that Google violated the law, he would then schedule a remedies phase of the trial to determine what should be done to bolster competition in the search-engine market. The government has not yet said what kind of remedy it would seek.
Russia promises 'devastating revenge' if Ukraine attacks Crimean Bridge
Russia promises 'devastating revenge' if Ukraine attacks Crimean Bridge (Recasts with more quotes, context, details) MOSCOW, May 3 (Reuters) - Russia warned on Friday it would launch a devastating revenge strike if Ukraine, backed by the West, strikes Crimea or the Crimean Bridge which links southern Russia to the Black Sea peninsula and has been targeted by Kyiv twice before. Moscow said it believed that Ukraine, which has recently taken delivery of long-range ATACM guided missile systems from the United States, was plotting to attack the bridge ahead of or on May 9, the day when Russia marks the Soviet Union's World War Two victory over Nazi Germany. Russia seized and annexed Crimea from Ukraine in 2014. Kyiv has repeatedly said it deems as illegal the construction of the road and rail bridge, which has been used in the past to move troops and weaponry. Ukraine says it wants Crimea back. Maria Zakharova, spokeswoman for the Russian Foreign Ministry, listed statements and social media posts by officials from Ukraine and European Union member states that she said suggested the bridge was in Kyiv's sights. Ukraine's U.N. Ambassador Sergiy Kyslytsya on May 1 posted on X what he called a 2024 list of 6 Main Types of Bridges with a set of images. The final image, labelled Kerch, the name of the Crimean town at one end of the Crimean Bridge, was left blank, perhaps suggesting it would be destroyed. Some East European diplomats and officials have posted similar content. The Crimean Bridge is once again in the crosshairs, Zakharova told a news briefing. Preparations for an attack on it, which is hard to believe, are now being carried out openly, with ostentatious bravado and with the absolute direct and shameless support of the collective West. I would like to warn Washington and Brussels that any aggressive actions against Crimea are not only doomed to fail, but will also be met with a devastating revenge strike, she said. Zakharova noted that British Foreign Secretary David Cameron said on Thursday that Ukraine had the right to use weapons supplied by Britain to hit targets inside Russia, something she said was proof the West was waging a hybrid war against Moscow. Crimea was part of the Russian Empire and later of the Russian Soviet Socialist Republic from 1783 till 1954 when Moscow gifted it to what was then the Ukrainian Soviet Socialist Republic, when both were part of the Soviet Union. Moscow now says that decision was a mistake. Russia's Black Sea Fleet, which has been repeatedly attacked by Ukraine, is based in Crimea.
