Partisanship makes ECI an election omission

Empires and emperors come and go, but some institutions remain immortal. The Roman empire vanished in 476 CE, but Pax Romana became the basis of modern justice. King John died in 1216 CE, but the Magna Carta laid the foundation of democracy. The individuals in charge are mere mortals. As long as they have the keys, they can make or mar the image of credible institutions through inept and inappropriate methods. The Election Commission of Indias (ECI) conduct over the past few weeks exemplifies such a degradation. It is being charged with delaying decisions, minimising transparency of data and ignoring genuine complaints by various candidates, especially from the opposition. Last week, it had mud on its face for taking almost 11 days to post the final polling numbers of voters in the first phase. The data didnt follow the precedential pattern and just gave the percentage of votes cast instead of constituency-wise details. Suspiciously, the final numbers vastly differ from the figures released by the ECI after the day of polling. The past has seen such delays, but this time the formatting and method was dodgy. In this digital age, when data can travel a million times faster than political volte-faces, the ECIs slow pace was abhorrent to even the most conservative pollsters and intellectuals. After all, it will decide the ruling party after June 2024. Despite unlimited money, resources and technology at its disposal, the ECI, in its wisdom, extended the election to seven phases in spite of the expected heat wave. Once upon a time, the ECI earned worldwide admiration for conducting elections in which over 100 crore voters in 543 constituencies decided their representatives. Except during the 1970s, Indian elections have by and large been fair and peaceful. The ECI faced political ire but its verdict was finally accepted by all the candidates. But no more. The ECI is their principal target, more than their political adversaries. Its not performance, but the perception that the ECI is controlled and directed by the BJP that has become its nemesis. The commission is basking in the glory of a record seizure of unaccounted money and drugsalmost Rs 100 crore a day since January. Yet its administrative initiatives, including fixing the election schedule and taking punitive and preemptive actions against contestants who habitually flout the Model Code of Conduct, are dubious at best. All three election commissioners have impeccable track records. The current CEC, Rajiv Kumar, an 1984 batch IAS officer of the Jharkhand cadre, was previously the Union finance secretary. He is credited with turning around the banking sector and introducing impactful financial reforms. The other two, IAS officers Sukhbir Singh Sandhu and Gyanesh Kumar, are closely associated with the Modi governments infrastructure push and Home Minister Amit Shah. Kumar was one of the key members of the home ministry team that worked on the secret exercise for the abolition of Article 370. However, the manner and suddenness of their appointments have led to myriad controversies. The Election Commission has become a sumptuous post-retirement habitat for random civil servants whose main credentials are loyalty to the establishment; their meritorious achievements are today the exception, not the rule. The ECI started life on a moral high ground when the reputed ICS officer Sukumar Sen was appointed to conduct the first Lok Sabha election and then the second one. Since then, 24 more chief election commissioners have occupied the exalted seat. Four from the ICS, 15 from the IAS, two from the IRS, one woman politician and two eminent constitutional legal eminences, Nagendra Singh and S L Shakdhar. The ECIs reputation was tarnished after politics superseded merit. For example, after V P Singhs government fell on November 7, 1990, V S Ramadevi, an advocate from Andhra Pradesh, was appointed the first female CEC on November 26, 1990. For inexplicable reasons, in two weeks she was replaced by the feisty T N Seshan. The shenanigans that followed after his stringent actions against electoral violations politicised the institution. Seshan imposed all legally available restrictions on candidates. High-voltage campaigns ground to a halt. For the first time, the government approached the Supreme Court seeking curbs on the CECs powers. The then-Prime Minister Narasimha Rao converted the ECI into a three-member commission and gave each one equal power. Leading a minority government, he couldnt alter the provision for the CECs dismissal, which says removal is only possible through a parliamentary resolution. Interestingly, while only the House can impeach the CEC, the authority to remove an election commissioner rests with the CECthe president may or may not accept the recommendation. This makes the other members vulnerable. They would fall in line. Converting the ECI into a multi-member body caused internal conflicts between the members. For example, in January 2009, CEC N Gopalaswami wrote to the president recommending the removal of his colleague Naveen Chawla. He accused Chawla of partisanship by overtly supporting the Congress. Gopalaswami was the home secretary during the previous NDA government and considered close to the Sangh parivar. The Manmohan Singh administration rejected the recommendation and Chawla became the CEC afterwards. Since then, successive governments have acquired the regressive reputation of packing the institution with individuals ideologically or personally aligned with the ruling party. Over the past 12 years, various governments have chosen retired or service-inactive babus. The current controversy stems from the fact that the two new members were about to retire or already hung their boots. They were chosen just a day before the elections were announced. The truth is, no political party wishes to abdicate control over the CECs selection. Even after the Supreme Court ruled that the government must establish a credible panel for selecting election commissioners, the NDA government defiantly dropped the Chief Justice of India from the panel and retained its majority clout. Such discretionary power enables the sarkar to handpick people who pass the twin test of pliability and compatibility. It is tragic that even prominent and eminent constitutional writers couldnt anticipate the misuse of the ECI by any ruling party. The Constitution has no provision for an independent selection mechanism for them, unlike in many other world democracies. For example, even the omnipotent president of the US cant appoint the mandated half a dozen federal election commissioners without the Senates advice and consent. Since it is impossible to change the Indian system, its the ECIs duty to protect its own credibility and acceptability. India has seen a vast increase in voter turnout. From 58.21 percent in 2009, it has risen to 67.40 percent under Modi. Going by the public perception that the prime minister is set for a record hat-trick, any doubtful and unjustifiable exercise by the ECI would not only raise doubts over the projected triumph but would also sound the death knell for yet another distinguished institution of Indian democracy. An election won with numbers must also be won with hearts. Caesars wife should be above suspicion. The Indian heritage of democracy

If modern India has been a successful democracy, it is because there is an ancient tradition of the idea. Participatory decision-making started in the ancient village councils or panchayatsa testimony to the grassroots democracy that thrived in ancient India. The Rigveda and Atharvaveda refer to the elections of king, prime minister and parliament by the people and some Brahmanas mention kings losing their positions. The people elected the best person as rajan . The king who failed to protect was deposed. The sabha , samiti and sansad were participatory institutions. The Ramayana and Mahabharata mention the involvement of people in decision-making. Indian texts say that the authority to govern is earned through merit and consensus, not heredity. There are several instances of elected rulers and their committees. India is a successful working democracy because the Indian people, since Vedic times, participated in governancefrom the village to the state. Governments in ancient and medieval India werecentralised under a king, but also de-centralised by devolving powers to local bodies and village panchayats in administrative areas in order to safeguard public welfare. Indian philosophy and polity are based on dharma which, along with artha (material wealth) and kama (desire), is essential for social welfare and happiness. Dharma means the law of righteousness, justice and morality, which sustains and ensures social welfare and progress. Kama and artha , that are contrary to dharma , must be rejected.Sovereignty rests in dharma and the maintenance of this dharma is the work of the sabha (eminent senior citizens) and samiti (popular assembly). The janapadas were governed by the village headman, while the mahajanapadas were republics or monarchies. The 16 mahajanapadas were known for their rich cultural heritage, military and economic prosperity. Lichchhavi, capital of the Vajji mahajanapada, was ruled collectively by an elected ruler ( rajan ), deputy ruler ( uparajan ), general ( senapati ) and treasurer. The citizens had the right to vote, deliberate and contest for public office. Each post was elected either through consensus or through an election. The sabha would meet and discuss issues. An adult in each family was a member. The public could decide on issues of importance by majority. The final judgement for crime and punishment rested with the elected heads, and records were maintained. Women were equal partners in the labour force, army, agriculture and husbandry. A detailed description of the democratic system comes from Tamil Nadu. The king had two teams, aimperunkuzhu and enperayam , who were consulted on all matters relating to the state. The village assemblies had substantial powers to govern locally. The roots of the system went back to earlier times, when kingdoms were divided into smaller units. The village, being the smallest unit of administration, had its local self-government known as sabha or gana . The village assemblies were the sabha and the mahasabha , and its members were perumakkal . The members of the assembly looked after temple endowments, irrigation work, tank maintenance and justice. The variyams or sub-committees looked after rural administration, including construction and maintenance of tanks, irrigation channels, land endowments and roads. Particular works were entrusted to groups of committee members, identified with a prefix such eri-variyam , a committee in charge of water bodies. The 10 th century Uttiramerur inscription describes in detail the rules for contesting elections to the variyams . They were selected by lots ( kudavolai ). They held office for a fixed term and were not eligible for re-election. The sabha fixed the method of appointing members to its variyams . The village was divided into wards ( kudumbu ) and the members were nominated according to the rules and regulations of the sabha . The major criterions for contesting the election were age, education, conduct and the requirement that the aspirant should be a taxpayer. The tenure of a committee was for one year and a person who had served could not contest the election again for the next three years. The contestants had to own taxable land and a house. The names of all contestants from the wards were written on palm leaves and put inside a pot. The ballot pot was shown to the villagers, after which a young boy took a leaf out of the pot and the name was read out. By this process, committee members from all wards were chosen. The Manur inscription is also known for its description of local self-government. The committee members of the local bodies consisted of unpaid part-time workers, but there were paid officials who worked full-time. On important occasions, a royal official was present at the meetings of the assembly. Similarly, the tribes of India have an extremely democratic form of governance. The elders of the tribe form a committee to manage their affairs and choose their leader. The social structure of the tribes ensures equal access to and ownership of natural resources. Many tribes give women prominent and even superior positions. India also has a tradition of religious democracy or bhakti , which challenged the caste system and was led by saints who helped the masses comprehend philosophical teachings. This is a unique form of democracy by which spiritual development was attainable by common people. Each saint had a favourite god or preferred form of worship and the goal was to finally merge with the divinity. There are several ancient works of polity, including the Arthashastra and Nitisara , on the science of politics. The Indian Council of Historical Research has a publication, Mother of Democracy India , which is a mine of information on the countrys democratic traditions. In Karnataka's Lingayat heartland, phase III of LS polls casts spotlight on BJP heavyweights

BELAGAVI: The third phase of polls on May 7 is poised for a closely contested battle between the BJP and Congress in the majority of the 14 of the 28 remaining seats in the state. However, all eyes are on the three top guns of the BJP, former Chief Ministers Jagadish Shettar, Basavaraj Bommai and Union Parliamentary Affairs Minister Pralhad Joshi, who have locked horns against three young Congress rivals in North Karnataka, a Lingayat heartland. The election for Belagavi, Haveri and Hubballi seats, where Shettar, Bommai and Joshi are in the fray, respectively, largely depends on which way the votes of the dominant Lingayat community swing . Given the popularity of the three leaders in North Karnataka, a Lingayat heartland, it looks as though the trio will emerge triumphant, but the contest in all three constituencies will go down to the wire if the changing political scenario on the ground is anything to go by. The trio does not have much to boast about development and heavily depend on the same 'Modi factor.' With an eye on the Lingayat votes , the BJP and Congress fielded Lingayat candidates in the Belagavi and Gadag-Haveri constituencies. When asked whether the attempts by the two parties to grab a major chunk of Lingayat votes will work, Siddarama Swamy of Gadag Tontadarya Math, who is one of the noted Lingayat seers in North Karnataka, said, The BJP is largely dependent on the 'Modi factor' in this election more than any other issue. Although efforts are being made to woo Lingayats, I don't think the Lingayat factor will help the candidates in this election. The caste factor will not play a major role even as the large number of voters in all three constituencies are Lingayats, he said. Unfortunately, efforts are being made to polarise society by the political parties for their political gains, he said, adding that the voters should not get carried away by all that and should support all the able candidates in the fray, irrespective of their party affiliations. Congress plans to corner BJP in North Karnataka with AHINDA-Lingayat combo The contest between Joshi and youth Congress leader Vinod Asuti is expected to be an interesting one after Dingaleshwar Swamy of Shirahatti Bhavaikya Peetha opted out of the contest in the Hubballi constituency. With the BJP and Congress fielding non-LingayatsJoshi is a Brahmin while Asuti is a Kurubait is interesting to see which way the votes of the Lingayat community swing in Hubballi. After quitting the contest, Dingaleshwar Swamy is still opposing the BJP's decision to field Joshi and trying to halt Lingayat votes going in his kitty. However, Joshi is confident of registering his fifth victory as MP this time. While sharing his views on how the Lingayat factor will play a role, senior Supreme Court advocate and political commentator Mohan Katarki said the Lingayat factor will play a major role in most of the 14 constituencies that go to poll on May 7. He believes a major chunk of Lingayats may vote for the BJP in the Hubballi constituency, where both parties have fielded non-Lingayats. The Congress should have fielded an OBC candidate from Haveri instead of Hubballi and given a ticket to a Lingayat from Hubballi to benefit from the Lingayat factor. The votes of the community will split between the two parties in Haveri and Belagavi but Joshi will benefit from them in Hubballi, Katarki added. Anandayya Gaddadevarmath, a not-so-popular Lingayat and Congress candidate from Gadag-Haveri, is also expected to put up a stiff fight against Bommai , with the possibility of a massive split of Lingayat votes. The BJP leaders feel Bommai will win by a big margin but several leaders of the Lingayat community expect a close clash here. According to official records, the sitting Haveri MP, Shivakumar Udasi of the BJP, polled a vote share of 53.97 percent against DR Patil of the Congress in the 2019 parliamentary election. Both candidates hail from the Lingayat community. On the caste factor, Jagadish Shettar , who faces youngster Mrinal Hebbalkar of the Congress, said the caste of Lingayat factor would not play any role in Lok Sabha elections. If you see the way previous elections were fought, you will find that the national issues assumed importance here. The voters will be more concerned about national issues than any others, he said. However, sources said the BJP and Congress have made all possible attempts to woo Lingayat voters in Belagavi constituency. Another noted Lingayat leader and BJP MP from Chikkodi, Annasaheb Jolle said his party had thesupport of all the communities due to the massive development done by Prime Minister Narendra Modi.
