Centres Report Cited No Punishment of Rohith

Hyderabad: The police report on Rohith Vemula's suicide, issued by the Madhapur ACP and investigation officer, was based on a study of the suicide letter, forensic lab reports, caste certificates issued by the Guntur district collector, school certificates and the report of the MHRD ministry-appointed committee headed by Justice Ashok Kumar Rupanwal (retd). In page 2 of the Justice Rupanwal report, the committee felt that it appeared from the records that the punishment was challenged in the High Court and the matter was pending at the time of Vemula's death. Therefore, the punishment could not be the reason for the suicide. The university had removed him from the hostel for holding protests and for the alleged assault on ABVP students. In the final report, the investigation officer forwarded Vemulas original handwritten copy to the then Vice Chancellor on December 18, 2015, to forensic lab experts to compare with the suicide note written by the PhD scholar. P. Rajini, assistant director, FSL, Hyderabad, established that handwriting on the both letter the letters were by the same person. The investigation officer said that they had approached the Jalagam Rama Rao Memorial Municipal School in Guntur seeking records pertaining to Radhika, who pursued her schooling from 1981 to 1985. It was found in her school records that she belonged to the Vaddera community. On Friday, Justice E.V. Venu Gopal of the Telangana High Court closed a bunch of five quash proceedings related to the Rohith Vemula suicide issue. The array of accused, who had moved the court to quash the cases against them, included the then VC of University of Hyderabad Podile Appa Rao, N. Susheel Kumar, Krishna Chaianya Yellapragada, N. Diwakar, senior counsel N. Ramachander Rao and another. The judge took on file the report of the prosecution that the allegations against the accused were a case of lack of evidence.

The university's progressive organisations have rallied for the withdrawal of the report and demanded action against the officers involved. The ongoing controversy surrounding the closure report has ignited significant unrest among students and social activists across the state and country who said the protests would only be intensified if damage control isn't done immediately.

Enhancing Quota to STs: HC Issues Notices to Govt

Hyderabad: The Telangana High Court asked the state government to respond by June 28 to petitions on GO No. 33 dated September 30, 2022, enhancing reservations for Scheduled Tribes (STs) from six to 10 per cent in education and governmental jobs. A division bench of Justice Abhinand Kumar Shavili and Justice Namavarapu Rajeshwar Rao, was dealing with a petition filed by two unemployed Group- 1 aspirants. They challenged the GO No. 33 and the notification issued by TSPSC for Group-1 exams, in which reservations for ST candidates were notified at 10 per cent. No HC Relief to Stone Crusher

Hyderabad: A two-judge panel of the Telangana High Court refused to grant interim relief to Aadeshwara Traders, who were told to close down their stone crushing unit at Vattinagulapalli. The panel of Chief Justice Alok Aradhe and Justice J. Anil Kumar was hearing a writ plea filed by the firm questioning the April 27 proceedings of the environmental engineer of TS Pollution Control Board (TSPCB). It was the case of PCB that the petitioner was operating its unit without a certificate for establishment and certificate for operations. The property where the petitioner sought to carry out eco-friendly stone crushing was in the prohibited area of of Osmansagar lake covered by GO Ms. 111. The order could also refer to an earlier order imposing a fine of Rs 49.3 lakh on the petitioner. The amount was brought down to Rs 24.6 lakh by the NGT. HC for service continuity Justice Juvvadi Sridevi reiterated the settled principle of the service law that the disciplinary authority cannot impose the punishment, which is not stipulated or prescribed under rules or regulations. However, given the peculiar facts of the case, the court refused to set aside the order of the revisional authority since much time had lapsed. The court was of the considered view that instead of setting aside the order, the interest of justice would be met if continuity of service was granted to the petitioner. The court was dealing with a writ plea field by T. Ramulu challenging the action of TSRTC in disciplinary proceedings. Appointed driver in 1996, the petitioner was chargesheeted in 2009 for having caused an accident leading to the death of a pedestrian. Disciplinary proceedings led to his removal from the service. The revisional authority in 2010, while holding that the order of removal as well as rejection of appeal passed by the earlier authorities were proper and justified, took a lenient view on humanitarian grounds, set aside the orders of removal and directed his reinstatement on certain terms and conditions. The case of the petitioner was that the accident happened because the pedestrian suddenly coming on to the road to stop the bus without knowing that it is an Express Service and in the process, the pedestrian dashed in the middle of the bus and that there was no negligence on his part and inspite of the same, he was made responsible. Hence, he prayed to set aside the order of removal as well as the order of revisional authority to appoint him as a fresh driver. Pending the writ petition, the petitioner rejoined services by agreeing to the terms and conditions imposed but after 6 years filed the writ petition. Condoning the delay and without going into Justice Juvvadi Sridevi however held it is to be noted that while driving any vehicle on roads especially when handling a heavy vehicle like bus, the driver must be cautious and patient as there will always be a scope for the smaller vehicles, pedestrians or animals coming on to the roads for various reasons and they must handle the bus carefully to avoid any collusion with them. Coming to the defence of the petitioner that the accident was ostensibly caused by the sudden appearance of the pedestrian, it is to be seen that had he been cautious and at a low speed, he could have controlled the vehicle and avoided the accident, for which, they are trained. For his lack of anticipation, he cannot blame the pedestrian for the accident, as no pedestrian would want to die in such a manner. However, the judge modified the order of the revisional authority declaring that the out of service period from the date of removal to the date of reinstatement shall be treated as continuous service for all purposes and the petitioner is entitled for the difference in salary as per rules.

No HC Nod for Underage Girl Keen on NEET

HYDERABAD: A two-judge panel of the Telangana High Court refused relief to a 16-year-old girl wanting to take the NEET medical entrance despite being underage. The panel of Chief Justice Alok Aradhe and Justice J. Anil Kumar was hearing a petition filed by Rithika Monika, represented by her mother, who contended that her childs performances in Class 10 and Intermediate showed that she was an extraordinarily gifted student. The panel called upon senior advocate L. Ravichander as amicus to assist the court. He pointed out that the regulations indeed prescribed inhibition whereby a candidate was required to be 17 years old as of December 31 and that the present petition was in the nature of seeking a mandamus contrary to the statute. The panel earlier voiced sympathy for the candidate but was also aware that entertaining such a petition could open the floodgates of multiple claimants. The panel further recorded the judgmnts of different High Court, including Delhi and Chennai, cited by Pujitha, the counsel for the Medical Council of India, and dismissed the writ petition.

Evidence Against Prajwal Revanna Withheld by Congress Government in Karnataka: Union Minister Sitharaman Union Finance Minister Nirmala Sitharaman on Saturday claimed that the Congress government in Karnataka did not take action against JD(S) leader Prajwal Revanna, accused of sexually abusing women, for about a year despite being aware of the matter. The Congress was afraid that it might lose Vokkaliga votes and therefore stayed silent until the first phase of the Lok Sabha elections got over, she said, speaking at a meeting with select journalists here. ''The Union home minister (Amit Shah) has made it very clear that we will not tolerate the matters that go against women and on that we stand united. Though the (BJP's) alliance partner has this issue, we have made it clear that it was not acceptable, and let it be investigated,'' Sitharaman said, when asked if the scandal will have an impact on her party's performance in Karnataka in the ongoing elections. It was being claimed that a driver gave a pen drive (allegedly containing evidence of Revanna's acts) to the Congress party and state home minister but they were sitting on this evidence for about a year, and ''now the BJP is made to answer because the JD(S) is in alliance with us,'' she said. The ministers of the Congress government knew what was in the pen drive but they did not think that safety of women should be their priority, Sitharaman alleged. ''They thought the Vokkaliga votes might go from their hands and decided to remain silent till the time the first phase of Lok Sabha got over. Now they are making it a big issue and pushing it which is typical of Congress and it shows their hypocrisy,'' the BJP leader further said, asking why probe was delayed for one year. The Karnataka government was now writing to the prime minister about the case, asking him to issue look-out notices against Prajwal Revanna and bring him back from abroad, but the Union home minister had clearly said that the Karnataka government can take all the action it wants to take, she said. Asked about BJP MP Brij Bhushan Sharan Singh's son Karan Singh getting ticket from the party for Kaiserganj constituency in Uttar Pradesh, Sitharaman said the allegations against the MP had not been proved yet. Brij Bhushan Sharan Singh is accused of sexually harassing women wrestlers. ''Nothing is proven against Brij Bhushan....even if he is convicted, I would say you want to carry the blame to the son. Even convicted people's children have been entertained by so many parties,'' the Union minister said. The BJP was still confident after two phases of the Lok Sabha elections of winning 370 seats on its own and 400 seats along with its NDA allies, she said. Asked if the BJP was in defence mode and responding to the opposition's narrative instead of setting its own, Sitharaman said this was not the case. ''Our response to the Congress' manifesto is not defensive, nor is it negative, rather it is more offensive and substantive,'' she said, adding that the manifesto was more of a Muslim League document. Later, in an interaction with students at an event at Deccan College in the city, Sitharaman talked about the Rohith Vemula case where the Telangana police have filed a closure report before a local court stating that the University of Hyderabad student was not a Dalit, and he died by suicide in 2016 as he feared that his ''real caste'' would be discovered. The issue was dragged to the streets without allowing the university to handle it with sensitivity, the Union minister said. ''It was an unfortunate incident. It was dragged to the streets and a narrative was built that the government was suppressing (facts) and was against students and SCs. Today, the same people who dragged the unfortunate family of Vemula on the street, should stand up before the entire country and apologise for having politicised it,'' she said.
